Power of Attorney Duties are administered by someone you legally appoint as your Power of Attorney. Executor Duties on Demand helps you simplify your Power Of Attorney Duties fairly and accurately.

What Is A Power Of Attorney?

An appointed Power of Attorney is someone you choose to manage your personal matters while you are still alive, and either temporarily, or permanently, unable to manage your own affairs. They do not need to be a lawyer, however, they should be someone you trust.

Who Should Be Appointed Power Of Attorney?

You can either choose someone that you know or an independent third party professional such as us to represent you as your Power of Attorney.

You should choose someone knowing they will act in your best interests to make decisions about all your personal matters. It is important to note that as long as you have the mental capacity to do so, you can continue to make decisions about your personal matters even when you have an appointed Power of Attorney in place.

An appointed Power of Attorney remains as such until your death, at which point, their duties end and an Executor or Estate Trustee takes over.

What Are Power of Attorney Duties?

Power of Attorney Duties are responsibilities outlined in legal Power of Attorney documents. Generally, they can do everything you can do with respect to your personal matters, accept the limitations specified below.

In Ontario, there are two main types of Powers of Attorney appointments:

  1. Power of Attorney for Personal Care
  2. Power of Attorney for Property

Under the Substitutes Decision Act, your appointed Power of Attorney is required to manage your personal matters to the best of their ability, and in your best interest. It is important to note that even if there are no limits in the Power of Attorney documents, they must still comply with legal policies and procedures.

Are There Limitations On What An Appointed Power of Attorney Can Do For You?

Yes. Your appointed Power of Attorney cannot make a Will for you, cannot change your existing Will, cannot change a beneficiary on your life insurance plan, or registered plan, or similar product, or appoint a new Power of Attorney on your behalf.

“I have known Michele for 20 years. Her enthusiasm, communication skills and professional demeanor were apparent prior to hiring her three years ago to assist my sister and I with our estate trustee responsibilities as named executors in my mother’s will.

We anticipated working without executor assistance, however, executing the will was more complicated than we originally expected.

Michele consistently affirmed our trust in her management of our estate trustee issues.

Michele is reliable, dedicated, and eternally upbeat with an ability to calm us with efficient and effective issue resolution suggestions.

Michele shared a wealth of relevant experience on estate trustee planning with timely meetings and written reports with accurate and thorough document preparation and filings.
